A recent ruling by the Transport Appeal Tribunal for Scotland, which has canceled dozens of Low Emission Zone (LEZ) penalty charges issued by Glasgow City Council.
The tribunal ruled that the fines were unenforceable because the council did not serve them using recorded or registered post, which was deemed mandatory for fixed penalty notices sent by post.
As a result, more than 20,000 LEZ fines issued between June and September have come into question, with 38 of them overturned due to the ruling.
Glasgow City Council has stated that these decisions do not create an obligation to refund paid penalties and that they are appealing the decisions to the Upper-Tier Tribunal.
The LEZ fines were introduced to encourage reduced emissions in the city, and similar schemes are planned for other cities in Scotland.
